There are two types of jihad in islam against infidels, and there are two types of jihad against infidels: 1. Jihad of demand (demanding the infidels in their country): such that the infidels are in a state where they do not mobilize to fight the Muslims, so fighting is a sufficiency obligation, and the lesser obligation is to block the borders with the believers to terrorize the enemies of God, and to send an army at least in the Sunnah, so the imam must That he sends a squadron to the battlefield once or twice every year, and the subjects must help him.
If he does not send, the sin will be on him (Hashiyat Ibn Abidin [3/138]). The jurists have compared it to the jizyah. The fundamentalists said: “Jihad is a coercive call, so it must be carried out as much as possible.” Until nothing remains except a Muslim or a peaceful person.” (Hashiyat al-Shirwani and Ibn al-Qasim on Tuhfat al-Muhtaj on al-Minhaj [9/213]). 2. Jihad al-Dhuf (repulsing the infidels from our country): This is an individual obligation, or even the most important obligation of notables, and is required in cases of: A. If infidels enter a Muslim town. B. If the two rows meet and the two marches meet. C. If the imam calls on individuals or people, they must mobilize. Dr.. If the infidels captured a group of Muslims.
But once the Sacred Months have passed, kill the polytheists ˹who violated their treaties˺ wherever you find them,1 capture them, besiege them, and lie in wait for them on every way. But if they repent, perform prayers, and pay alms-tax, then set them free. Indeed, Allah is All-Forgiving, Most Merciful.
Surah At-Tawbah 9:5

It is known that the jihad in which a person is seeking what is wanted is more obligatory than this jihad in which he is seeking what is not wanted, and the souls in it are more desirable in both ways.
As for the jihad in Islam of pure pursuit, no one desires it except one of two men who has great faith and fights so that the word of God is supreme and the religion is entirely for God.

Narrated Anas bin Malik:
Allah’s Messenger said, “I have been ordered to fight the people till they say: ‘None has the right to be worshipped but Allah.’ And if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us and we will not interfere with them except legally and their reckoning will be with Allah.”

What do you think of those who claimed that jihad can only be carried out by an imam, and even Palestine must have the permission of the imam, and in Iraq he said; Their jihad is a jihad of sedition, because it is without the permission of the Imam. What do the scholars say about this matter, may God reward you with good?
This would only be said by an ignorant person whose insight has been obscured, or who is under duress, because it is a false statement according to all scholars and rejected by the group of jurists. I will quote to you what he mentioned in Major Calamities [Part Three / pg. 11], which is a book that contains the fatwas of the Maliki scholars of the Arab Maghreb regarding calamities. This fatwa is by Imam Abu Abdullah Sidi Al-Arabi Al-Fassi, may God have mercy on him, and consider what he said about it:
What some tongues are raving about in these times, that jihad is not permissible due to the loss of the Imam and his permission, is a word inspired by the devil of the jinn to the devil of mankind, and he expressed it in his permission and then threw it on his tongue in the trappings of his delirium, a temptation for the servants and a discouragement from jihad.
Although the Maliki masters do not have jurisdiction over this, rather it is a matter agreed upon among the schools of thought, I liked this fatwa because of its good detail and sound deduction:
Here is the entire fatwa:
“As for the third issue: The obligation of jihad in islam does not depend on the presence of the imam and on his permission in general, and it is clearly known that jihad is a goal in relation to the imamate, which is a means to it, since in most cases perfection is not achieved without it, so if it is possible to achieve it without it, there is no meaning left for it to depend on it. So how can possible goals be abandoned due to the loss of the usual means? If the Imam was present, he asked for his permission, preserving the orderliness of the matter, the unity of the word, and the adherence of the group. And something may arise that makes it likely that he did not ask for permission, such as fear of missing an opportunity due to the Imam’s distance, or the fact that he is unjust and fears that his whims will overpower him in missing it. It is unjust and he was prevented from jihad without consideration. He would not abstain from jihad if he was safe from harm on his part..”

In this paragraph, he explains the necessity of alienating Muslims for one of two purposes: desistance, and transferring them to Islam. We said that desistance is not specific to transgressors, just as conversion to Islam may also include transgressors, as we have explained previously.
Here the discussion is about making the obligation to fight when they start fighting not conditional on anything, and making the obligation of fighting when they stop fighting conditional on the position. The apparent meaning of his words is that he does not stipulate the obligation of jihad in Islam in imposing the first with ability, while ability is power and ability is a condition for directing the obligation in all actions to their doers. Therefore, the author of Al-Jawahir interpreted the words of the investigator in imposing the first on the presence of the ability to repel the enemy, deter him, and stop harming him, and in the second the ability to subdue them. Islam and fulfilling the conditions of dhimma if they are among its people.
Then we must search for the obligation of jihad in Islam, does it include primary war? In other words, is it necessary to fight a polytheist simply because he does not convert to Islam until he converts to Islam or is killed, and is it necessary to fight the People of the Book until he converts to Islam or surrenders to the conditions of dhimma, otherwise he is killed? Or is war in Islam defensive? Is it not permissible to fight a peaceful person, whether he is a polytheist or one of the People of the Book (Christians and jews and Magianism?
The apparent meaning of the words of many of our jurists is the first, and here are some texts of their words:
Sheikh Al-Tusi, may God be pleased with him, said at the end: (Everyone who opposes Islam from all types of infidels must be jihaded and fought. However, they are divided into two parts: one that only accepts Islam and entry into it, or they are killed, their descendants are taken captive, and their money is taken. And they are all… Types of infidels, except the Jews, Christians, and Magians. The other group are those from whom the jizya is taken. They are the three types that we mentioned. For when they submit to the jizya and accept it and fulfill its conditions, it is not permissible to fight them, and it is not permissible to take captives of their descendants. And when they refuse the jizya. Or they violated its conditions, their ruling was the ruling of other infidels in that they were obligated to kill, take captive children, and take money. (Al-Nihayah fi Mere Al-Fiqh and Fatwas, p. 291).
